SEC. PANELO: Good noon, MPC. As I was saying, you can never be angry at members of the MPC. I’ll always be amused with the questions that you raise. ‘Di ba sabi ng mga nanonood sa atin, “Very…” anong sabi, “animated…” oh biro mo ‘yun? Itong si Ina ayaw buksan iyong reaction ng media sa accomplishments ni Presidente, eh wala naman siya noong Monday—ay noong ano… O, go go go go…

MARICEL HALILI/TV5: Hi sir, good morning. Sir, kahapon we were able to interview Secretary Nograles, and it seems that they—Secretary Nograles and Secretary Teddy Locsin has the same statements saying na the verbal agreement between President Duterte and Chinese President Xi Jinping cannot be enforced because there is no black and white.

SEC. PANELO: Ano bang hindi ma-enforce? Hindi ba, ano pa ba ang tawag mo doon? Hindi ba—iyong usapan… may usapan sila na puwede kayong mag-fish dito, hindi gagambalain iyong mga fishermen. Hindi ba nangyayari na nga?

MARICEL HALILI/TV5: Pero sir, paano iyong mechanism ng enforcement? Because I think the question is, ano iyong terms and conditions?

SEC. PANELO: O, hindi ba sinabi na rin ni Presidente… kung ano iyong sinabi ni Presidente—exactly he was quoting the exact conversation between the two.

MARICEL HALILI/TV5: So bakit magkaiba, sir? It seems na magkaiba iyong sinasabi po ninyo versus doon sa sinasabi nina Secretary Nograles?

SEC. PANELO: Ang sinasabi ko, kung ano iyong sinabi ni Presidente. Kung iba ang interpretasyon ng mga kasama natin, they are entitled to their own interpretation. Baka hindi—alam mo kasi unang-una, they were not there, wala sila doon eh. They were not yet in the Cabinet, so baka that’s one reason kaya hindi nila nakuha. Pangalawa, alam mo sabi nga ni Presidente kagabi, “Ang problema kasi sa mga hindi nakakaintindi ng sinasabi ko,” hindi na naiintindihan nila like iyong sabi niya, “Did you allow?” Anong klaseng tanong nga naman iyong ‘Did you allow?’ Sinasabi na nga na iyong China, as far as they are concerned owns the entire South China Sea and they are in possession. Ano bang klaseng tanong iyong ‘allow’, paano ia-allow, nandoon na nga sila eh. Kaya nga nag-uusap tayo na huwag tayong magkasakitan, iyon ang hindi ninyo naiintindihan. That’s exactly the word of the President.

MARICEL HALILI/TV5: So sir, you maintain the position that the verbal agreement is—

SEC. PANELO: Oh, yes! That is the position of the President, not my position. I’m just echoing the position as a Spokesman of the President; if you cannot agree with that, eh wala tayong magagawa, eh… ganiyan talaga iyan.

MARICEL HALILI/TV5: Meaning sir, the verbal agreement is legally binding?

SEC. PANELO: Oh, yeah. Eh nangyayari na nga hindi ba? Kung ano iyong napag-usapan nila, nangyayari na. Hindi tayo pinapakialaman sa Reed Bank, pagkatapos pinapabayaan na mag-fish iyong mga fishermen natin sa Scarborough Shoal. O hindi ba, ano pa bang tawag mo doon?

SEC. PANELO: Ah… Hindi ba sabi ni Secretary Lorenzana, we will conduct our own inquiry on that kasi wala tayong firsthand knowledge.

GENALYN KABILING/MANILA BULLETIN: Will the Palace ask China to at least explain what happened?

SEC. PANELO: We will investigate on our own. We will do it our way.

JOSEPH MORONG/GMA7: Sir the Pentagon, the US has already confirmed also the report of the CNBC. What do you think of these actions by the Chinese?

SEC. PANELO: Wala. We will investigate pa nga eh then we will make our official stand. We will not rely on the say-so of whatever source.

JOSEPH MORONG/GMA7: So, you cannot describe it yet sir kasi—

SEC. PANELO: No, hindi pa natin alam.

JOSEPH MORONG/GMA7: You don’t think that’s possible that they’re testing the missile?

SEC. PANELO: Oh whether it’s possible of not, we will have to wait for the inquiry.

JOSEPH MORONG/GMA7: Sir, just a little bit on the verbal agreement.

SEC. PANELO: O, doon pa rin tayo. Okay…

JOSEPH MORONG/GMA7: It seems that… yesterday si Secretary Nograles is saying that iyon pong sabi ni Presidente na ‘Will you allow’—iyong question ‘no, ‘Will you allow the fishermen, the Chinese to fish in our seas?’ And then he said, “Of course, I will.” Ang sabi po nila diyan kahapon, ni Secretary Nograles is that, it is a compass, it’s a wish, it’s a desire of the President. But for that to be enforceable, it has to be reduced as—myself pointed out, into a document. Meaning, anong coverage mga ganoon… na mga bagay. We don’t have to proceed to that, sir?

SEC. PANELO: Gaya nga ng sinabi ko, iyon ang interpretasyon niya. Alam mo he is a lawyer, and as I’ve repeatedly said, even when I was in private practice: There are as many opinions as there are lawyers; kung iyon ang basa niya, eh iyon ang basa niya. But the position of the President remains the same, it has not changed. Kung ano iyong kinuwento niya exactly na nangyari, narinig ng lahat ng Cabinet members iyon at mangyayari ngayon.

JOSEPH MORONG/GMA7: Uhum… Can—I’ll be direct, and this is the same question that was given to Secretary Locsin. Can the Chinese fish in our EEZ?

SEC. PANELO: Hindi ba sinabi na nga… Uulitin ko iyong sinabi—

JOSEPH MORONG/GMA7: Yes sir, I get the point—

SEC. PANELO: Kung you get the point, why do you have to ask? Anyway, uulitin ko iyong sinabi ni Presidente. Ang problema kasi, iyong tanong na iyon na “Will you allow?” Ano bang allow? Eh nandoon na nga sila, they’re there. As far as they’re concerned, they own it. O, kaya nga kami nag-usap na lang na, “O puwede ba, huwag istorbohin iyong aming mga mangingisda doon?” O, nagkausap kami… o hindi ba nangyayari nga. Hindi na sila iniistorbo sa Scarborough, hindi naman sila nakikialam sa Reed Bank. O, ano pa bang tawag mo roon?

JOSEPH MORONG/GMA7: Alright sir, I’ll rephrase my question. Will we prevent China from fishing in our EEZ?

SEC. PANELO: Basta iyon ang posisyon ni Presidente, may usapan sila – ‘yun na ‘yun, as is na iyon.

JOSEPH MORONG/GMA7: Should the Coast Guard enforce our laws when there is poaching?

SEC. PANELO: Ang Coast Guard, alam nila ang gagawin nila. They know their duty, so we will leave it to them.

JOSEPH MORONG/GMA7: And the duty is what, sir?

SEC. PANELO: O ‘di you ask them… they should know. They are the Coast Guards.

JOSEPH MORONG/GMA7: And, we don’t know?

SEC. PANELO: No… I don’t think so you know, because you’re asking me. The Coast Guards have their own specific duty in accordance with law. You want to know their duties? Then you have to look at the law exactly what their duty is.

JOSEPH MORONG/GMA7: And under the Fisheries Code, they will have to prevent.

SEC. PANELO: Basta—ha?

JOSEPH MORONG/GMA7: In answer to your question: Under the Fisheries Code, they would have to prevent poaching – whether it’s from China, Vietnam, Indonesia or elsewhere. Do you agree that they should do that?

SEC. PANELO: They should know what to do, because they know their duty – that’s my answer.

JULIE AURELIO/PHILIPPINE DAILY INQUIRER: Sir, here’s a related question. Marine scientists from the University of the Philippines said that the Philippines loses about 33.1 billion annually from the damaged ecosystem sa Panatag and Spratlys due to Chinese reclamation activities and illegal fishing operations. First of all, is the Philippine government aware that the damage or losses to the Philippines has reached this magnitude? And second: What has the government done to address it?

SEC. PANELO: First we do not know about that. We have to let the particular agency or department responsible for that – and I think this is under Department of Agriculture, kasi iyong Fisheries sa kanya – they should conduct a study on that, to validate that particular finding of one particular group.

JULIE AURELIO/PDI: It was conducted by marine scientists from the UP MSIE, sir?

SEC. PANELO: Kaya nga, then we will have to make our own study.

JULIE AURELIO/PDI: What do you think should be done to prevent, if proven true, what do you think should be done to them?

SEC. PANELO: Oh, eh pag nandoon na tayo, then we will know what to do. Right now, hindi natin alam kung totoo nga iyon o hindi.

JULIE AURELIO/PDI: But you think that this kind of report would necessitate preventing Chinese fishermen from destroying?

SEC. PANELO: When the assumption na totoo, eh hindi pa nga natin alam. Kaya nga sabi ko nga kanina, we will have to study. The specific department concerned with that should conduct an inquiry on that matter and then the government will undertake measures.

JULIE AURELIO/PDI: But in general, is the government concerned or is alarmed with this kind of findings?

SEC. PANELO: We will always be concerned if it affects the security of the state and it affects the general welfare of the people.

ROSALIE COZ/UNTV: Good afternoon, sir. Sir, another report says mas marami daw pong foreign vessels na lumalapit sa coastline ng mga probinsya ng bansa sa West Philippine Sea. So, hindi po ba ito cause from concern – from 2016 to 2018?

SEC. PANELO: Kaninong report iyan, who was reported that?

ROSALIE COZ/UNTV: Karagatan patrol, sir.

SEC. PANELO: Ano ba iyan, gobyerno o private? Then, we will have to validate that. The Western Command should validate such report.

ROSALIE COZ/UNTV: Sir, doon po sa verbal agreement.

SEC. PANELO: Nandoon pa rin tayo? Sabi nga nung mga nag-reaction: “Ate, move on ka na, ha.” Nandiyan pa rin tayo, aba eh talagang.. mga reaction ninyo.

ROSALIE COZ/UNTV: Di ba President Duterte during his oath taking in 2016, ang sinusulong niya po ay transparency. So iyong verbal agreement po, is the Palace willing to show to the public, sabi n’yo naman po na may record noon at documented. Is the Palace willing to show it to the public?

SEC. PANELO: Sinabi niya na nga exactly as it transpired – kung ano iyong sinabi niya. We should trust the President’s words. Besides nandoon kami and all of us are saying narinig namin lahat iyon. Maiksi lang naman iyong conversation nila, hindi ba kinuwento niya, iyon lang iyon.

ROSALIE COZ/UNTV: And then sir, former Solicitor General Hilbay said the senate should investigate about the informal agreement between the two presidents. So, what does the Palace say about this?

SEC. PANELO: Sabihin mo hindi na siya SolGen, tumahimik na lang siya. Alam ninyo itong mga kandidato noong mga nakaraan, they have been overwhelmingly repudiated by the electorate and the issues they have raised against the President and this administration have been factored, because iyan ang naging linya nila paulit-ulit na linya nila against the President and the administration, eh tinanggihan na nga sila. Eh ayaw pa rin silang maniwala na hindi sila pinaniniwalaan ng taumbayan.

ROSALIE COZ/UNTV: So, sir itong particular na isyu na ito, confident po kayo na hindi nito maapektuhan ang popularity ng Presidente in the coming months and weeks?

SEC. PANELO: Definitely at saka alam ninyo, sinasabi nga ni Presidente, it doesn’t matter to me ke popular ako o hindi, basta ang gagawin ko, what I will do is I will perform my duty in the Constitution as directed to me, which is Section 4, Article ll, saying that his prime duty being the head of the government is to serve ad to protect the people, di ba paulit-ulit niyang sinasabi iyon? “Hindi naman ito popularity game,” sabi niya.

SEC. PANELO: 4th of July, bakit kahapon nangyari iyon.

SEC. PANELO: Kaya nga, kagabi, 3rd of July lang kagabi di ba?

JINKY BATICADOS/IBC 13: Parang event lang iyon, sir.

SEC. PANELO: Okay.

JINKY BATICADOS/IBC 13: Sir, merong plano daw ang Pangulong Duterte na bumisita ng America, anytime this year?

SEC. PANELO: Saan naman galing iyong tsismis na iyan.

SEC. PANELO: Ah matagal na niyang sinasabi iyon, noon pa iyon.

SEC. PANELO: The latest eh wala pa, walang pang latest.

JINKY BATICADOS/IBC 13: Pero if in case sir pupunta ang Pangulo doon, what is the nature of the visit, state visit?

SEC. PANELO: Depende kung ano ang imbitasyon sa kanya di ba – depende iyon kung sino ang mag i-imbita.

JINKY BATICADOS/IBC 13: Pero as of now talaga sir, wala pang napag-usapan?

SEC. PANELO: Wala pa.

JINKY BATICADOS/IBC 13: Sabi ni Arjay sir, is he open daw?

SEC. PANELO: Ano?

JINKY BATICADOS/IBC 13: Is he open to go to the US, kasi parang noon, di ba sinabi niya ayaw?

SEC. PANELO: Kung Tatanungin mo siya, ayaw niya di ba.

SEC. PANELO: Well, di ba sabi natin circumstances change and make the stand altered.

PIA GUTIERREZ/ABS-CBN: Sir on the resignation of GSIS President Aranas…

SEC. PANELO: Oh, yes.

PIA GUTIERREZ/ABS-CBN: You said, this morning that President Duterte has accepted the resignation of Mr. Aranas. Is it true that he has lost his confidence with Mr. Aranas because of allegations of impropriety, corruption?

SEC. PANELO: No, the President just accepted the resignation.

PIA GUTIERREZ/ABS-CBN: What was the reason sir, for him to…

SEC. PANELO: No reason. Kasi the person which submitted the resignation letter states the reason why he is resigning, he said for personal reasons. I do not think we can dwell on the privacy of that person.

PIA GUTIERREZ/ABS-CBN: Sir, can we confirm report that prior to his resignation, Mr. Aranas talked to the President?

SEC. PANELO: Kailan ba nangyari iyon? Ang alam ko may cabinet meeting kami the day before. The day before, may cabinet meeting kami, so papano siya kakausapin? Eh natapos kami past 12 midnight na, nag-start kami halos mga 5 o’ clock.

PIA GUTIERREZ/ABS-CBN: Because the report did not indicate when the meeting happens.

SEC. PANELO: Hindi ko alam. I have no info on that and not privy to whatever.

PIA GUTIERREZ/ABS-CBN: Pero, did President Duterte asked Mr. Aranas to resign?

SEC. PANELO: No, he did not.

JOSEPH MORONG/GMA7: Sa Coast Guard sir.

SEC. PANELO: Kuya, moved on ka na, sabi ng mga— Ituloy mo, ituloy ang tanong.

JOSEPH MORONG/GMA7: Tapos papayagan mo ako ngayon. Sir, iyong Coast Guard report..

SEC. PANELO: Ah, iyong tinext mo kanina. Ilabas mo na iyan.

JOSEPH MORONG/GMA7: Yeah, kasi inunti-unti na ni SFA.

SEC. PANELO: Oh di Antayin natin si Presidente dahil siya naman ang may hawak ng report, hindi naman kami.

JOSEPH MORONG/GMA7: Yeah, but you are aware of iyong kay SFA na parang sneak peek into the report.

SEC. PANELO: Iyon, siya pala ang nakaka-alam, di dapat siya ang tanungin mo kung nabasa niya, ako hindi ko nabasa eh.

JOSEPH MORONG/GMA7: So, you don’t know sir iyong mga ano?

SEC. PANELO: Hindi ko alam ang detalye. I have not received a report or viewed any report or seen any report.

JOSEPH MORONG/GMA7: Kasi sir, ang sinasabi po niya doon in broad strokes that our fishermen may not, based on the report, ang quote niya is…

SEC. PANELO: ‘Not in the best lights,’ that is what he said.

JOSEPH MORONG/GMA7: Correct, so you know the report.

SEC. PANELO: Iyon ang sabi niya, iyon din ang nabasa ko.

JOSEPH MORONG/GMA7: What do you think of it, sir?

SEC. PANELO: I don’t think about it. I’d rather let him speak for himself.

JOSEPH MORONG/GMA7: But sir, if may mga ganiyang findings, does it diminish the liability of the Chinese fishermen? I’m not saying the Chinese government – Chinese fishermen.

SEC. PANELO: Hindi, bakit naman madi-diminish kung iniwan nila to the wilds. Maaari bang hindi sila liable doon. They have to justify their action. And the only justification will be their lives would be endangered. Eh hindi naman, I don’t think so.

JOSEPH MORONG/GMA7: Sir, iyon pong IMO, iyong may EO na pinirmahan si Presidente regarding the International Maritime Organization, does that something to do with our investigation?

SEC. PANELO: Which EO? Hindi ko alam ito.

JOSEPH MORONG/GMA7: Parang, sir, iyong nag-o-organize tayo ng parang task force for IMO.

SEC. PANELO: Hindi ko pa alam iyan. I have no info on that yet.

PIA GUTIERREZ/ABS-CBN: Sir, do you have plans to talk to Cabinet Secretary Nograles and SFA Locsin over the issue?

SEC. PANELO: Dati naman kaming nag-uusap. We’re always talking with each other. Alam mo, sabi ko nga, eh iyon ang kanilang basa eh bakit ko naman ipagpipilitan kung ano iyong … Basta ang pagpipilitan ko lang ay kung ano ang posisyon ni Presidente. If that’s how they read, they interpret iyong sinabi ni Presidente, they are entitled to that.

PIA GUTIERREZ/ABS-CBN: Pero don’t you see the need to clarify the issue with the officials in the administration?

SEC. PANELO: Hindi na. Very clear na iyong sinabi ni Presidente: Kinuwento niya exactly what transpired; tapos naman kaming mga nakarinig, sinabi namin, ‘Oh narinig namin iyon.’ Ano pa ba ang dapat i-clarify? Iyong dalawa naman wala naman doon so …

PIA GUTIERREZ/ABS-CBN: Do you see that their statements are creating confusion in the public sir, on the status of the verbal agreement?

SEC. PANELO: Only to those who want the issues confused. Kasi wala naman … actually, wala namang silang … there’s no contradiction naman. Ang sinasabi nila, the policy is huwag papasok sa EEZ. Ang sinasabi naman ni Presidente, ang problema nga diyan, iyang policy na iyan ay sila ang may hawak ng buong karagatan. Kaya hindi natin pupuwedeng ipagpilitan ang sarili natin sa kanila kasi nagri-react din sila. Kaya nga I want to avoid any armed hostilities. Kaya hindi na ako maghihintay magkaroon ng gulo diyan – iyon ang sinabi, klarung-klaro ang Presidente. Kaya nga sinasabi ni Presidente, ‘Aba, napakasimple lang, hindi nila maintindihan.’

PIA GUTIERREZ/ABS-CBN: Iyon nga sir, so don’t you think there’s a need?

SEC. PANELO: Hindi na, kasi ang confusion is in their minds eh. You may know, not the Cabinet – iyong mga ang basa kay Presidente ay ganoon. Eh klaro naman iyong ano, very clear iyong sinasabi ni Presidente.

PIA GUTIERREZ/ABS-CBN: So you’re talking about CabSec Nograles and SFA Locsin?

SEC. PANELO: No, I’m referring to everyone, including you – all of you.

SEC. PANELO: Kung iyan ang basa ng dalawa, anong magagawa natin.

PIA GUTIERREZ/ABS-CBN: Sir, the fact that there is confusion on the issue, don’t you think that there is a need to do something about it, sir?

SEC. PANELO: No. As far as the President is concerned, and as far as I’m concerned also, very clear ang sinabi niya. There is no room for any interpretation.

PIA GUTIERREZ/ABS-CBN: Exactly sir, there’s no room for any interpretation especially within the administration. So don’t you think there’s a need to clarify with the officials?

SEC. PANELO: As far as the President is concerned, iyon ang posisyon. Iisa lang ang posisyon – kung ano iyong posisyon ni Presidente, iyon na iyon.

PIA GUTIERREZ/ABS-CBN: Okay. So wala pong pag-uusap na gagawin or clarification within the administration—

SEC. PANELO: Wala. Basta I just listen to the President, iyon lang iyon.

ARJAY BALINBIN/BUSINESS WORLD: Sir, Labor Secretary Bello said, he is hoping President Duterte to sign the security of tenure bill into law before SONA as it will form part of the achievements for the first three years.

SEC. PANELO: Yes, that is his wish. I don’t know whether his wish will be granted prior to the SONA.

ARJAY BALINBIN/BUSINESS WORLD: But of course, sir, the welfare of the labor sector is among the priorities of the Presidente, right?

SEC. PANELO: Yes. But whether or not it will be signed before or subsequent to the SONA, the welfare of the people is still there, na nasa isip ni Presidente. Kapag pinirmahan niya kahit na after the SONA, eh di ganoon pa rin ang epekto.

MARICEL HALILI/TV5: Sir, follow up doon sa question ni Pia. Sir, don’t you think—

SEC. PANELO: Ano na naman?

MARICEL HALILI/TV5: No sir, because don’t you think it is necessary to fine tune the statement of all the Cabinet secretaries so as to produce—

SEC. PANELO: Hindi na. Ang pakinggan ninyo ay iyong Presidente. Kung ano iyong sinabi ni Presidente, iyon na iyon.

MARICEL HALILI/TV5: But aren’t you concerned of the possibility or the impact of different statements—

SEC. PANELO: Hindi, wala naman akong nakitang impact. Which impact, anong impact?

MARICEL HALILI/TV5: Confusion.

SEC. PANELO: Hindi, ang nagko-confuse lang kayo naman, eh wala naman akong nakitang confusion.

MARICEL HALILI/TV5: Pero, sir, the fact na magkakaiba iyong interpretation ng mga Cabinet secretaries sa the same issue—

SEC. PANELO: Magkakaiba nga kasi wala sila doon. Iyon na nga ang sabi ni Presidente, wala kasi iyong dalawa doon. Kaya let’s understand them.

MARICEL HALILI/TV5: Are you saying sir, that their interpretation is incorrect?

SEC. PANELO: Ano pa nga ba, kasi hindi iyon ang ano eh, hindi iyong sinasabi ni Presidente. But they are entitled to their interpretation. Eh kung iyon ang intindi nila, ano ang magagawa natin.

MARICEL HALILI/TV5: So mali iyong interpretasyon nila doon sa—

SEC. PANELO: Draw your own conclusion. Basta the President’s line is this—

MARICEL HALILI/TV5: So, yes or no?

SEC. PANELO: Ah hindi – draw your own conclusion.

JOSEPH MORONG/GMA7: Okay, sir. The statement of the President—let’s focus on you. The statement of the President is that we do not need permission ‘no, to give to China because anyway, they’re claiming the sea, they own it, tama? That’s the statement of the President, yes?

SEC. PANELO: Yeah.

JOSEPH MORONG/GMA7: That sounds like surrender?

SEC. PANELO: No.

JOSEPH MORONG/GMA7: Why?

SEC. PANELO: Bakit magiging surrender. Hindi ba sinabi—paulit-ulit na tayo. Sinabi na nga sa inyo na iyan ang reality sa baba. They claim sovereignty over the entire area.

Now, iyong isang particular provision is saying na, i-enforce natin iyan kasi iyon ang sinasabi ng provision. Ang sinasabi naman ni Presidente, kapag ginawa ko iyan eh baka iyong gusto ninyong i-protect ko ay mawawala sa ating lahat. Kasi kapag ginawa ko iyan at awayin natin ang Tsina, magkakaroon ng hostilities. And under the Constitution eh ang aking pangunahing tungkulin is to serve and to protect. Kaya nga exasperated na si Presidente, bakit hindi ninyo makita iyong napakasimpleng paliwanag niya.
